Agreement and service

These terms govern access to and use of PropRetire, operated by Propretire Pty Ltd (ABN 53 696 271 619). By creating an account or using the service, you agree to them. If you do not agree, do not use PropRetire.

PropRetire is educational planning software for Australian property portfolios. It produces planning estimates from records and assumptions. It does not provide personal financial, tax, lending, legal, accounting or valuation advice.

Account security and authority

Registration creates one Personal or Business account with one registered user. Sign-in credentials are for that user only. You must keep them secure, must not share them and must tell us if you believe another person has used them.

Two-step verification is optional for Personal accounts. PropRetire requires it for Business accounts as a product security control. Available security factors include passkeys and authenticator apps. Setting up two-step verification also provides one-time recovery codes. You must protect your factors and recovery codes.

Password reset relies on access to the registered email address and does not disable two-step verification. If two-step verification is enabled, account recovery also requires an enrolled factor or recovery code. Support cannot bypass these checks. You can revoke active sessions, and PropRetire may revoke sessions after password, email or security-factor changes or when needed to protect the account.

If you register or use a Business account on behalf of an organisation, you confirm that you are authorised to accept these terms and use PropRetire for it. You must also have authority to enter and use information about a client or any other person.

A portfolio contact identifies a planning case. It does not create another user, give the contact access or authorise the contact to act on the account.

Your records and decisions

You are responsible for the records and assumptions you enter, including whether they are accurate, current and complete and whether you have the right to use them. You are also responsible for deciding how to use a PropRetire output.

Your records and the operational licence

As between you and PropRetire, you retain any rights you hold in the records and assumptions you enter. You give PropRetire a limited, non-exclusive licence to host, copy, process, transmit and display that material only as needed to operate, secure and support the service, carry out your requests and meet applicable legal obligations. This operational licence does not transfer ownership of your material to PropRetire.

PropRetire and its licensors retain their rights in the software, product design, documentation and content supplied with the service. While your account has access, the registered user receives a limited, non-exclusive and non-transferable licence to use the service for personal planning or authorised Business work. You must not resell, repackage, scrape or reverse engineer the service except where the law permits it.

Acceptable use

You must use PropRetire lawfully and only with information you are authorised to use. You must not seek unauthorised access, bypass security controls, upload malicious code, interfere with the service or use its outputs to mislead another person.

You must not present a PropRetire output as professional advice issued by a qualified adviser unless that adviser has separately reviewed and adopted the work.

Availability and ending access

Features, data coverage and the providers needed to run the service can change. PropRetire can also be unavailable because of maintenance, incidents or provider outages. These terms do not promise uninterrupted access or the continued availability of a particular feature.

We may restrict, suspend or end access for a breach of these terms, misuse, non-payment or a security or legal risk.

Consumer rights and liability

Nothing in these terms excludes, restricts or modifies a right or consumer guarantee that the law does not allow us to exclude, restrict or modify, including under the Australian Consumer Law where it applies.

To the extent the law permits, PropRetire is not liable for indirect or consequential loss, lost opportunity or profit, market or investment performance, tax outcomes, lending decisions, or loss caused by records or assumptions that are incomplete, inaccurate or out of date. This limitation does not apply where the law does not allow it.

Governing law and contact

These terms are governed by the laws of New South Wales, Australia. Any rights that apply regardless of that choice continue to apply.
